Terms and Conditions of Sale
By placing an order with On Stage Media Australia (“OSMA”, “we”, “us”, “our”), you agree to the following Terms and Conditions.
1. Privacy & Personal Information
We respect your privacy.
Personal information collected at the time of ordering is used solely for the purpose of:
- Processing and fulfilling your order
- Contacting you regarding your purchase
- Delivery of products
We do not sell, share, or disclose your personal information to third parties except:
- Where required by law
- Where necessary for payment processing or delivery
- Where consent has been provided
Images and videos will not be supplied to third parties, including event or festival organisers, without appropriate consent. Please note that consent for event-wide media use may be granted separately via your competition or event entry form.
2. Event Filming & Photography
OSMA is contracted by the event organiser to film and/or photograph performances.
It is the responsibility of the event organiser to:
- Notify participants and parents of our presence
- Obtain any required permissions from competitors
We make every reasonable effort to capture each performance; however, due to live event conditions, technical limitations, scheduling changes, or circumstances beyond our control, we cannot guarantee coverage of every performer.
If a performance is not captured due to circumstances within our control, a refund or credit will be offered at our discretion.
3. Orders & Payment
- All orders must be paid in full prior to processing.
- Orders will not be delivered until payment has cleared.
- All sales are final. Refunds will not be issued for change of mind.
- Products are made-to-order and are considered personalised goods.
Under Australian Consumer Law, you are entitled to a remedy if a product is faulty, significantly not as described, or fails to meet consumer guarantees. Nothing in these terms excludes your rights under Australian Consumer Law.
4. Pre-Orders & Non-Appearance
If a pre-order is placed and:
- The performer does not appear, or
- The performance is withdrawn
A refund or credit may be issued upon notification and confirmation of non-performance.
5. Accuracy of Order Information
It is the purchaser’s responsibility to provide accurate performance details, including:
- Section number
- Competitor number
- Performer name
- Additional identifying information (e.g. song title, costume description)
OSMA is not responsible for errors arising from incorrect information supplied at the time of ordering.
If you believe you have received an incorrect video or image, you must notify us immediately so the issue can be investigated and rectified where possible.
6. Troupe & Group Performances
Orders for troupe, group, or school items will not be released without the express permission of the choreographer, studio owner, or principal.
Written approval may be required prior to fulfilment. This may result in processing delays, for which OSMA is not liable.
7. Prize Giving Photography
OSMA does not routinely photograph prize-giving presentations for individual purchase unless specifically directed to do so by the event organiser.
8. USB Returns & Physical Media
If a USB or physical product requires return due to defect or replacement:
- The customer must return the item to our nominated PO Box
- A return envelope will be provided where applicable
- Replacement products will not be issued until the original item is returned (unless otherwise agreed)
OSMA is not responsible for items lost in return transit.
9. Image & Video Quality
Event photography and videography are captured under live stage conditions, which may include:
- Low lighting
- Coloured or theatrical lighting
- Venue restrictions
- Stage fog or effects
- Painted or uneven backdrops
While every reasonable effort is made to ensure professional results, customers acknowledge that live performance environments may impact image clarity, colour, and lighting consistency.
Minor variations in lighting, focus, colour, or background appearance do not constitute a fault.
10. Child Protection Compliance
OSMA operates in accordance with Australian child protection legislation.
We reserve the right to:
- Refuse or cancel an order
- Decline to release media
Where we reasonably believe that releasing content may breach child safety laws or child protection obligations.
11. Limitation of Liability
To the maximum extent permitted by law:
- OSMA shall not be liable for indirect, incidental, or consequential loss
- Liability is limited to the amount paid for the specific product ordered
- We are not responsible for delays caused by third-party services, event changes, or force majeure events
12. Acceptance of Terms
By placing an order with On Stage Media Australia, you confirm that you:
- Have read and understood these Terms and Conditions
- Agree to be bound by them
